They can't use the share price - the shareprice is a consequence of the breach/sales of collateral in such a case



The judge may very well argue that any effect from shorting/breach on the share price cannot be determined objectively. Therefore, the share price at maturity is the best way to determine punitive damages.

And then you can suck it up.
