5.) Mr. Klein has repeatedly told this Court that he lacks a basic understanding of this case and has attempted to blame Plaintiff for his own failure to review documents or interview or depose witnesses.

Since Mr. Klein’s clients produced no documents (except a few by Blackburn early in the investigation) and instead dumped them at WarRoom (a third party document imaging vendor), Plaintiff subpoenaed those documents, and all parties received the same 313,000 documents at the time Plaintiff received them, which was September 14, 2016. The documents Plaintiff intends to use at trial from the WarRoom production were identified on Plaintiff’s trial exhibit list in early February.

Most of the crucial documents the Officer Defendants previously withheld from discovery but which we obtained from WarRoom were also contained in the Appendix to Plaintiff’s MSJ. As Ms.

Further, Mr. Klein’s letter continues the irrelevant rants he consistently includes in all filings relating to anonymous bulletin board posters who are not part of this case, and which do not relate to any pending claim or defense. He then repeats the nonsensical allegation that “this Court has been defrauded into being a vehicle for the campaign of character assassination needed for the crimes at large,” presumably not referring to the activity of his own clients but unidentified “crimes” that are not part of this case and which he believes have been committed by anonymous people intent on victimizing his clients, or by the SEC. These irrelevant musings of counsel are not “evidence” and should be ignored.
