Not at all. No failure as it hasn't gotten that far. KBM has been following court procedures and can't force BK until the courts finish with the default litigations. KBM can get receivership of all hjoe assets, or the courts assign a firm to manage the receivership settlement. Either way common shareholders lose totally.
This January should be closer to the final blow to hjoe as a company entity. I'm not a lawyer and I don't know how many more loopholes and delays hjoe can do at this point so we wait until that date passes for more concrete information.
