I'm not really sure what this sentence means.

You speak, now and previously, as if you are searching to find the common code - the code that the infringers leveraged and are now infringing with. As if, if that doesn't exist, there is no infringement.

The patent can be a a process. The process takes into account numerous factors (VPLM argues more factors than have been taken into account before) in routing VOIP packets. Apple is doing that same process, and there is no obvious way they could do that without taking into account these additional factors (this may be the key your missing -- that there is no other way to achieve the same goal), which probably means they have implemented an infringing process.
