The vast majority of the time he just affirms.
Affirmation isn't great outcome, but affirmation
means we move to district court.
My concerns on Judges aren't about not getting anything back,
but making sure WDDD moves forward.
Moving forward is the only way this makes money.
Plain and simple.
Now how many claims, which claims we have, lose, or get back that
will determine how much money is to be made.
We can get back through either Wifi One or Oil States becoming a factor if either or both goes favorably, that helps. The stats point to about 80% of the time simply getting an affirmation.
IMO WDDD case is strong, but I will not be on that panel unfortunately.
