The banner link from the official Transmeta site does give the same rough top line but that is because it is a component of a drop down menu. You are displaying an out of context-orphaned version, which by all means should exhibit a proper border. In the end it is your site but I really think the banner being displayed void of a closed border is just a little bit tacky.
