I feel you.I believe your position is valid and possible.
I am prepared if it goes that way too, but I see best case scenario and worst case scenario and play the middle since it has the highest probability of happening, but being aware of both. No point inn getting locked in on any of it, but be mentally and fiscally prepared for all.

I am obviously taking a more optimistic approach.
Plus I am thinking a court date settles this a little, maybe bring in a few new people. Judge Panel selection will have an effect, i know some people are waiting for that before doing anything. So a good draw moves us up, and a bad draw will bring us down.
Then orals happen, see how the reaction to that goes.
During all of this Wifi One is pending, and after all this Oil States will be pending, so I see little things that can keep us in this general range unless bad news along the line, which is still a possibility.
SO the wait, wait, wait does have some things n the middle to break it up.
