Oh, I guess that would be insider trading.

Why would it be inside trading for Apple (or any other company) to invest their money in VPLM, with the awareness that they may also be in talks to buy it in a more consolidated form.

That doesn't seem like inside trading to me, since the entity with inside knowledge is simple executing that plan in the public arena of buying shares.

I don't know the rules - so I'm not saying your wrong - just looking to understand the angle.
