I think the flaw in that reasoning is how much resources it takes to win against a company like Apple or some of the other biggies. Most of the time they welcome it as they know they have what it takes to beat the crap out of a snot nose little company like vplm (in their eyes). Tiny little companies w/no income & no tangible product don't win against the likes of apole. Yes, anything is possible but hugely unlikely. But taking on a small infringer and winning would create the snowball effect because regardless of who is sued for infringement, according to vplm, any & all of the VoIP services providers are automatically infringing by virtue of the fact they utilize voip. It's not like some are infringing & some are not. Not according to vplm. Therefore a win w/a small infringer would automatically set the big boys a shakin in their boots because infringement has now been established by a court of law. Do you follow? Then they (the big dogs) would know beyond any shadow of doubt that their days are numbered.
