I've been to small claims a number of times. It's nothing like a trial where you have to convince a jury because there's no jury. The judge makes his decision based on the facts of the case. Impugning his character isn't relevant to the case at hand. This is all in my opinion, I'm no expert nor am I an attorney. Sorry to say that I believe the safe harbor statement that he uses will protect him from damages. However nothing would please me more than seeing him pay a price for his antics.
