Why wouldn't Hipple and Benz also be sanctioned?

I remember the SEC press release about the Micro-cap Enforcement division being especially tough on the "gatekeepers".

"The principal goal of the Task Force will be to develop and implement long-term strategies for detecting and combating fraud in the microcap market, especially by targeting "gatekeepers," such as attorneys, auditors, broker-dealers, and transfer agents, and other significant participants, such as stock promoters and purveyors of shell companies."

Hipple was sanctioned in 2010 - banned by SEC for 5 years from participating in any securities activity.

My wishful thinking suggests that Hipple will be getting acquainted with the Justice Department.
