That is why I have continuously indicated since day one that they need to settle this thing and move on. What started off as a drip from the faucet has become a broken pipe. While the ethics of stall and delay on a lawsuit is abhorrent, a lot of companies do it for monetary reasons and it makes sense from a financial perspective.
They can often negotiate for a reduced settlement as cases drag on and on; however, in this case, they are crazy to stall even one minute longer. They lost and now have a ticking money bomb on their hands. JNSH no longer has to perform as the discovery is all one-sided and delay costs CCGI more every day in potential damages, interest and legal fees. They need to get this off their books yesterday.
