November 27th is a motion hearing. Usually not much changes with these post-trial motions. It is still possible the judge will find the jury was not "reasonable" and grant a Judgment as a Matter of Law. That is a discretion in unusual circumstances.
German court asked ESET to produce source code to a third party. Kind of a waste of time they didn't volunteer it as it has already been made available in US court case. Once it is confirmed what Finjan already stated, ESET could receive injunction barring sales. German courts don't normally award much money. Infringers are slapped with injunctions which result in them negotiating license deals in good faith.
I don't think many expected much out of this trial. It is just an add-on to BC I. Anything at least $15M like Proofpoint and Sophos should be seen as positive. Much more is possible and would be gravy.
BC III is also coming up in Germany. Don't sell too soon if there isn't much of a pop here. An injunction barring sales would be a killer for BC/Symantec in Europe. Still hopeful of a grand settlement before it could get to that point.
