RE: naked shorts

Naked short selling is prohibited by the SEC. Doing so is a violation of SEC rules by is not illegal per se as in committing a crime that will put you in jail. It is not an uncommon tactic and the SEC seems to look the other way. So for anyone in the know I have 2 questions:

1) Is there any proof that someone is or has naked shorted Torvec/Curaegis shares? Seems the only ones who would know for sure are the naked shorter(s) and the market maker who made it possible and neither of them are likely to openly admit it.

2) If there indeed is a naked short position by one or more persons, how many shares are involved?
