A single district court judge - one - finds that the payment of the CSR is not kosher and everyone views this as correct and rule of law
A circuit court with a 2:1 vote finds that the judicial castration clause in HERA supports the majority of the Lamberth decision and
and 20 posters here lament the loss of rule of law !!!
huh? is that not a direct internal contradiction ? how - other than political bent - do the two differ that one is rule of law and one is the end of rule of law
When a judge rules - there will be many who like it and many who do not - but it is on its face rule of law
So for those who enjoy that one judge found 7-8B a year not kosher and view that as rule of law - you must accept that anti F and F court decisions are also rule of law
I did not say you need to agree with the decision - I do not agree with the ACA or the FHFA decisions - but the court spoke and until appealed (successfully) that is the rule of law
NOTE ---- this judge found that the HOUSE (congress) had standing in a situation never before so found. Put aside the ACA - if left to stand - then any time Congress is in the hands of the opposing party it will then have standing to second guess in court every WH / Executive decision and there goes separation of powers
