Sure. Here you are! These are the facts straight from Health Canada.

So the claim here is “EAPH\Alliance Group has received legal approval to grow, cultivate, distribute (sell) recreational & medical marijuana. This is legally completed with no objections from Federal & Local Authorities. The 45 zoned and approved land EAPH\Alliance Group owns is in process of having greenhouses built on it now.”

So let’s go through this. Hopefully afterwards, the spreading of false and misleading statements on this forum that are clearly not true will stop. If someone wants to share this magical exemption, please post the information and the link as I have done below or it should be considered misleading conjecture as far as I am concerned.

So this begs the question, if the production site cannot be outdoors, has to be indoors and the license will only be approved AFTER the facility has been built, how could they possibly have received legal approval to grow, cultivate, distribute(sell) as is claimed when they do not have any buildings on this so called property? Also, the license to ‘sell’ is only issued AFTER the first grow cycle has occurred, an inspection has taken place and is a separate license you file for as an amendment to your original license. See below. It is absolutely 100% impossible first of all for them to have been issued a license to grow with no building and a license to sell without going through the first grow cycle. Health Canada’s standards and words not mine.

Pre-Sales Inspection (prior to issuance of sales license)
If a licensed producer wishes to add the activity of sale to their existing licence, an amendment application must be submitted to the Office of Medical Cannabis. Health Canada will then schedule an inspection to verify that the licensed producer is meeting the requirements of the ACMPR including, but not limited to, Good Production Practices, packaging, labelling, shipping, and record keeping prior to allowing the sale or provision of product.
Issuance of Licence to Sell
To complete the assessment of the requirements of the ACMPR and establish that adding the activity of sale of cannabis products is not likely to create a risk to public health, safety or security, and to confirm that there are no other grounds for refusing the amendment application, the following information is reviewed:
• results of the pre-sale inspection;
• information submitted in the amendment application to add the activity of sale to the licence; and
• any other relevant information.
When the review is completed, an amended licence, including the activity of sale, is issued to the licensed producer. The licensed producer may now begin supplying cannabis products to registered clients, other licensed producers and/or other parties named in subsection 22(2) of the ACMPR, depending on the activities licensed. Separate licences may be issued for dried marijuana, plants and/or cannabis oil.

Are inspections part of the licensing application process?

Yes. Health Canada will continue to inspect all facilities as cultivation begins and before a licence to sell products to the public is issued. Health Canada will schedule this first inspection after it has determined an application meets the regulatory requirements and it has issued the licence to cultivate and once the producer is ready to initiate production in its facility. This approach will help provide successful applicants with a decision on their application as soon as possible while ensuring that all facilities are inspected as cultivation begins.

6. PROPOSED SITE INFORMATION
If you intend to conduct licensed activities at more than one site, a separate application must be completed for each site along with an explanation detailing the multi-site operation (if applicable)

If the proposed site is comprised of more than one building in which proposed activities are to be conducted, please provide information on each building. For multiple buildings attach additional sheets as required.
Include the following supporting documents:

An up to date building location survey, prepared and certified by a qualified surveyor. The survey document should show the lot dimensions and the relative location and dimensions of all buildings and improvements to the property. The perimeter of the site should be clearly identified on the document.

A recent aerial view (e.g. an aerial photograph or other imagery) of your proposed site showing surrounding lots within a radius of 500 meters from your proposed site

8. PROPOSED SITE AND PHYSICAL SECURITY
Please attach a detailed description of the security measures and floor plans of the site, including:
Each of the building(s) within the proposed site where activities are to be conducted:

Note:
Any licensed activities proposed to be undertaken at any proposed site

So yet again maybe someone can explain how they can possibly have a license to produce let alone a license to sell when they don’t even have a building to be inspected????

Straight from the Health Canada website below is a list that contains ALL licensed producers who have been issued a license by Health Canada. Guess who is not on that list. There is no circumventing this, there is no magical hidden exemption, you either have a license and are on the list or you don’t. Period.
