I get the feeling, they’re counting on the Oil States Trial next month

My feeling is that the Court might very well rule against the Patent Office, which is a positive.

I also feel that even if that happens they will NOT eliminate the IPR process, which is a negative but IMO a most likely outcome from all of this.

Based on what I've read many legal opinions out there conclude that the IPR process is in fact constitutional so from here it's a "WE WILL SEE" situation but realistically to be counting on the Oil States case for validity seems a far stretch.
