Last year tax loss selling was used as a scare tactic (surprise!). Turned out not to be the case. By looking at the last 60 days of 2016, the closing price of November 1 was the same as December 30.

11/01/2016 - $1.16
12/30/3016 - $1.16

No trial result was expected between November and December of last year. This year B-OM is expected in October/November and P is expected in December/January.
