The exploitation is for the "construction material". The permit would have allowed them to sell any coal they came across while mining rock - the permit language you quoted even says the coal is a "by-product" of the rock mining. Nothing more.

NEWC did not explore the property at all. It is not a "mine" in any definition of the word.

Campo told the SEC he was awaiting the issuance of the environmental permit to BEGIN COAL EXPLORATION ON THE PROPERTY. Not mining.

You can't mine something that hasn't been discovered.

Or, again, are you claiming Campo lied to the SEC about having conducted NO exploration on the property whatsoever?
