Nothin' wrong with applying for a patent---it did, however, give the apologists/promoters several years to tout the "patent pending" IP angle...that is coming to an end one way or another---he will either overcome this final round of prior art objections by the examiner---or the application will die...

then there is the divisional application spun off this one that has already been non-final rejected and is moving down a similar path..
