This is layman guess.
DOJ as a agency is not the defendant. DOJ responsibilities are very broad in scope. Pleading for Gov in court cases is very very small part of it.
It appears, DOJ attorneys work independent of DOJ-AJ but based on DOJ policies and Client agency instructions. My guess, plaintiffs may have been ok with their attorneys working for others also.
