Just to be clear, 'prosecuting a patent' is different from litigation. .
Patent 'prosecution' is the process of writing and filing a patent application and pursuing protection for the patent application with the patent office. It does not mean there is any legal challenge going on.


Its a strange choice of wording by the patent industry, but well established.
