Dozerman, both sections 1 and 2 state that the dismissal would be w/o prejudce. So even if the judge didn't get involved, it still is recorded w/o prejudice. And that means the case is not totally dismissed but Plaintiff is able to re-litigate case.

So...I will concede, could be judge didn't get involved in final dismissal w/o prejudice. But the end result is the same.

If it's no. 1, then Rossi agreed that Truxmart had the right to relitigate the case.
