Ice.. ICM people feel they got caught a weak Gers in the net! Gers nibbled on a piece of straw, nothing that would satisfy their appetite! Just to serve the purpose of avoiding court time for their opponents, ICM won the "Favor" of the year award from Gers? Why the hell did Gers even give-up one day of fruitless mediation time, when they have the lawyers on contingency, self-incriminating words from ICM Officials themselves, (and who virtually said they used Gers patents to both sell-out to Customers, and/or use as a basis for the development of their own versions of our Patented system,) and other cards in their hands that none of us know about? Why? IMO, there might well have been talk in the original Court appearance, where the Mediation subject was brought-up to both parties, where Gers might have felt they would do themselves a disservice by not agreeing to it? They might have fell into a trap that will make them look bad anyway you look at it?
In a mediation, both Parties are expected to make compromises, even though they might be unfair to Gers, but will stand against them if they didn't lower their demands! Even though being the little guy in this case, Gers may look extremely selfish in asking for all that money, and giving up virtually nothing in the mediation! To the judges, who want to breakdown the immovable stances both Parties have, especially Gers, who is doing all the asking, a lot more will have to be given-up by Gers than they expected to! Judges always feel that asking for a great deal of Punitive awards may be a sign of greed, rather than actual damages, especially if ICM comes up with something that corroborates their feelings! That is why Gers Lawyers have to find the dirty underhanded things ICM is doing, or have done in the past, to make ICM the villain, not Gers? And it is paramount that they (The Lawyers especially,) find other actions outside of their dealings with Gers, to bring to the judges! Maybe that is why Gers decided to enter the mediation? They just didn't have enough "Ammunition" regarding ICM's past dealings? IMO...T..
