This is the weakest arguement ever.
If Dan Scott and Currah went in to rob dans bank and Dan grabs some money but Scott trips the alarm. He can't say that he grabbed less than was in his account and if it wasn't for Scott the cops wouldn't have come, so he is innocent

It doesn't matter what lame excuse you use. Scotts actions do not justify Dans criminal actions.

Dan took someone else's money and used it for his own gain.
Yes Scott conned Dan. That doesn't excuse Dan from stealing others money and using it on the con.

Dan broke the law no excuse gets him out of it.
