Not all defendants need to agree on a settlement
(see this link ), so it might be that GERS reaches an agreement with some of them, but I agree it might be harder if the biggest one doesn't agree. However It might be that the smaller defendants run out of money if it takes too long.

About "Who is paying Steven B. Pokotilow" I would think Attorney Steven Pokotilow of Stroock and Stroock works side by side with Cantor Colburn attorneys. And C&C is named as a interested party I think Cantor Colburn must have hired Stroock and Stroock, so they would also be payed on contingency base, or directly by Cantor Colburn. But I don't think GERS is paying them.
