I cannot say when the court will decide to grant the motion, but the motion is in, nonetheless, and the court may act without notice. If the court sees the SEC is conducting a witch hunt, the court would act accordingly. OR the court will allow the proceedings to continue.
However, through examination of the court dockets, it appears the SEC really rushed into their case. Keep in mind, the SEC filed their complaint in June of 2016 over events that took place in August of 2011. They haven't even provided details to their own allegations.
Anyone can read through the filings. It's actually comical at points. I've literally LOL'd at some of the cookie-cutter maneuvers made by the SEC. All tactics and protocol.
