the fda says the product is not a dietary supplement **publically** but privately i get the sense they may not saying that.

ecommerce arm of gnc picked it up [lucky vitamin]
heard a "major supermarket" picked it up; have tried to get more info to no avail. i think they are trying to keep it quiet so as to not upset the small ma and pa shops and to not add fuel to the fire for the competition. if i had to guess it will appear as it does on lucky vitamin.
