No way to know, too many issues: elimination of inequitable conduct claim, declaration of patent validity, direct damages (back royalties), punitive damages, future licenses, other infringing companies back royalties and future contracts, press releases, execution of ICM's commitment of indemnification, etc., etc., ...

This is why I have always been in the camp to press on with the appeal which would have cleared out a lot of these issues with one action. But they must know better and hopefully someday we will find out what those reasons were.
