I would sue Currah and all involved for conspiracy to commit fraud. These are just my observations so I imagine real lawyers and management will know a lot more.
Based on the insider ownership in that email posted here recently, which shows the Currah family were part of the control block back in 2007, (likely an OSC issue regarding his ban which was recently put in force at the time). Further, as admitted here by Surorov (who seems to know Currah very, very well) he found the property, worked on the property, made corporate decisions, brought in investors, was involved in arms length transactions, etc.
So Currah was really an undisclosed insider and all involved conspired to hide his involvement due to the OSC Ban. So he and the rest are responsible (Keevil and Ben Fuschino were officers so had a duty to disclose properly) for disclosure of Andrew Currah's involvement while offering sales of securities in the US and thereby conspiring to defraud investors. Undisclosed insider and failing to disclose are a big no-no in US securities laws.
There is obviously way more to go on but that is where I would start, and then I would follow up with insider trading and more securities violations before I move to Canada on Niostar issues, as those are secondary.
There is also the Shining Tree private placement where friends of mine (not myself thank god) gave Scott and Currah money for Shining Tree (must be that 750k Suvorov mentioned was spent) and received no stock or other consideration. No Shining Tree stock, nothing. A few documents do show Scott trying to offer Canadian Cannabis shares to make up for this - so there is a big paper trail. That, of course, is an OSC securities concern, fraud etc.
Of course, once these happen, then any shareholder or private placement participant can join in and make claims for losses against all of the parties involved (Currah family, Fuschino, Keevil) under the same disclosure allegations above.
Lots to go on here. Can't wait! Will they all go down with the ship or will they turn on each other like rats?
