Think about it. The judge had no idea that fnf pay all their money to treasury. That's like fnf case 101 info that even the most transiently involved retail investor knows. If she can't grasp the implications of that...how can she get into the more nuanced fare in the plaintiffs arguments. Beyond that, the entire government attorneys argument was pretty much "We can do whatever we want bc Congress and bc no court has ruled in favor of shareholders so you should rule the same way.
This thot of a judge is just another in a long line of busy judges that don't want to put the govt on the hook for billions. So they take the lazy way out and give the case the same treatment that some low level traffic court judge gives to a speeding ticket case in which someone was going 15 mph over the speed limit.
