A PR or 8K is no proof he's gone. These scammers know how to manipulate investors. It was obvious that Toby was hated as a lying deceiving manipulating CEO, as are 95% of OTC CEO's...so, he hatched a plan to turn over the lead to some other guy who is in Toby's pocket...and now they will both make money. Simple as that.
