@nathanial Yes, they can certainly apply. Here is the problem. Most of the posters who advocate this scenario seem to assume that the application is the same as the extension itself. This is not true. We have to look at NASDAQs perspective. They need to protect the integrity of their market. They don't want to be affiliated with stocks that have prices in the pennies...period. So if you are NASDAQ on what grounds would you grant an extension? The people at NASDAQ are not dumb; they can easily see the history of this company and the likelihood of positive cash flow being zero for several years with almost no means to acquire additional capital. This is the problem. IMO DCTH would have to meet the 10 consecutive days over 1.00 themselves or no go.
