I don't believe that you can make the statement that the SEC didn't take any lead from OTCM. I have no doubt that OTCM brings certain situations to the SEC's attention. Don't forget that OTCM's compliance office is also in Washington. In this case, it is entirely possible that OTCM saw the mailer piece before anyone at the SEC noticed it and that OTCM informed the SEC about it. The SEC takes leads from lots of resources including individuals. It's called the Whistleblower Program.
