A reply to a non-final office action, filed within six months of the office action, satisfies the applicant’s obligation and keeps the application pending. Such a reply places the case back on the examiner’s docket, and the applicant doesn’t need to do anything further to keep the case pending. However, a final office action requires the applicant to appeal or file an RCE to keep the case alive.
