What we've been seeing are T trades.
So, really it's not up to the broker. Simply trading pre-market and after hours on the OTC isn't allowed. I have evidence to the contrary on a couple different securities on the OTC, but it's not supposed to happen. And how they got away with it, is still a mystery to me. What's normally seen are T-trades. Those are last reporting sales trades that for one reason or another (stupid high speed algorithm computers maybe) didn't get reported during normal hours.

Last sale reports of transactions executed between midnight
and 8:00 a.m. Eastern Time shall be reported between 8:00 a.m. and 9:30 a.m. Eastern Time on trade date as ‘‘.T’’ trades. Transactions not reported before 9:30 a.m. shall be reported after 4:00 p.m. and before [6:30] 8:00 p.m. as .T trades.



FINRA emphasizes the obligations of members to report securities transactions within the required time period. All reportable transactions not reported within the required time period shall be marked late, and FINRA routinely monitors members' compliance with the reporting requirements. If FINRA finds a pattern or practice of unexcused late reporting, that is, repeated reports of executions submitted after the required time period without reasonable justification or exceptional circumstances, the member may be found to be in violation of Rule 2010. Exceptional circumstances will be determined on a case-by-case basis and may include instances of system failure by a member or service bureau, or unusual market conditions, such as extreme volatility in a security, or in the market as a whole. Timely reporting of all transactions is necessary and appropriate for the fair and orderly operation of the marketplace, and FINRA will view noncompliance as a rule violation.

So, if you see an AH or PRE market trade, look at the tape. It should show a "T" before or after the trade share amount.

You can literally go nuts reading SEC and FINRA rules. About as boring as reading a full 10-K too.
