How people proceed is up to them.
My point of view changes with the information I have available.
I wasn't in favor of the buyout before and wanted to sue, and put POW! in an auction, up for sale to the highest bidder. I think other companies would have made a higher offer, if they knew POW! was for sale.
I'm currently in favor of the buyout and will go for dissenter rights, and reserve the right to sue. I currently believe the assets could bring over $1 per share, if IP value is used to judge fair value by Delaware.
My point of view may change again should I come across different information. No one should base what they plan to do on what I am currently planning to do.
If someone started a proper class action lawsuit, I might jump on that.

Right now, I think a class action lawsuit could initially claim damages of $3 million, with maybe more after after a proper discovery process. I think there are enough cases of breach of fiduciary duty to ask for punitive damages (might be worth ten times actual damages).
It looks like shareholder apathy might keep a lot of people out of a class action lawsuit concentrating the payout to a few shareholders.
