The company is required to file the DEF14A for the meeting in which items are to be voted on in a shareholder meeting. IF they had filed the PREM14A by mistake, the company would be required to retract or amend their filing so that it was recorded that the wrong form had been filed in error. Also, the length of time between both filings indicate that the PREM14A was filed correctly.
