I somewhat expect to see that litigation thrown out, because it seems to me that it should be directed at the Trustee and not Syncora. Which is why Fir Tree was pushing the Trustee to act for the past three years (not Syncora). But you never know, these are complicated cases, and that will be compounded by the fact that Fir Tree is seeking a trial by jury.
Can you imagine the people getting pulled into that jury panel, being that they likely know nothing of monolines, RBMS, etc? That would be a shit show.
