I checked their 10K filing of 12/31/2016 and it states that they were in fact operating as a company before share rails. However the troubling part is that they are using open source code from MySQL to write their software. That explains why they could not get patents for their software.
Open source is more economical to utilize but it is something anyone with an IT software engineer could replicate in a short period of time.
That severely undercuts the value of their product and their ability to maintain marketshare.
