Easy...basic contract law.

When two parties form a contract, the party to be charged can not fail to perform or it is a breach of contract. The government already performed their part of the contract. The NWS is FHFAs part.

If FHFA does not send the NWS payment, they have breached. However, the Treasury can cancel the NWS because FHFA already got its consideration from the original bailout.
