There are a couple of reasons that you might be getting that answer...assuming that they are being honest with you (after all, it is the liquor business).
1. They may not have a retailer who is willing to ship.
2. They may not have a retailer with inventory in NY.
3. As Carini just discovered, NY was on the list of States that "only allow direct wine shipments". I say "was" because that fine bit of research sourced to the National Conference of State Legislatures had a date of January 12, 2016 on top of it. So we can't discount the possibility that liquor will be allowed to ship in New York at some point (assuming that the law hasn't changed already)....of course we shouldn't be surprised that Passion told you that they are "hoping that will change soon". It's the business they are in and who knows how long they have been hoping.
I was given that information....I don't know.
