That's not true in it's entirety. There's been only a small portion that's been paid out. The majority is still owed by AdvisorShares. Thomas can also claim damages against some of the players involved with Fund. The lawyers even if they file a claim won't get anything more. The only lawyers that will get paid from the millions still owed by AdvisorShares will be Thomas's lawyers which aren't getting a percentage of the remaining payout or distribution. If AdvisorShares defaults on the payment then Funds in a great position to pick up a decent percentage of AdvisorShares company which would be the best case scenario for the shareholders.
