What makes Greebel think that prosecutors are unaware of possible crimes Shkreli make have committed? It wouldn't surprise me if:
a. prosecutors are fully aware of any criminal history, and
b. they deliberately chose not to prosecute those offenses.
Not only that, but if prosecutors are fully aware of any possible criminal history, they will not inform Judge Matsumoto of this during the sentencing phase of the hearing, where previous criminal activity is a factor to be considered.
So if Greebel thinks that he can rock the prosecutors' boat with whatever facts he may have to substantiate his claim, playing that hand may only serve to antagonise the prosecutors in his own case.
