To my understanding if the wells are 3000 feet or less they can be fracked. Not sure what qualifiers, or regulations are in TX, but in North Dakota Baken field near Williston where all the fracking action is occurring in Wells that are shallow 3000 feet deep or less. To the South the deeper prize "Three Forks" field region is much deeper, between 3000 and 8000 feet. A lot more expensive of course but if it's shallow it should be a plus then..
