I covered this several times and i have no problem covering it each and every time one of yall ask that question.

Sometimes in business it is easier to regain assets illegally taken by employees by not getting the police involved. Look at it this way... The promise to not seek prosicution is a carrot and the threat to seek prosicution is a stick. The carrot works faster in business cases than the stick. IF the company were to seek prosicution why the hell would Frank turn over the assets? He would simply dig in and use every legal delay to prevent TMM from regaining those assets in under 20 years. Do you want to wait 20 years to get the film library back if it is gone? Frank will go to jail under your plan, get a sentence of about 5 years and be out in 1 year and we will still be waiting another 19 years for the appeals to make it to the suprem court and be refused to be heard. In the mean time frank could sell the assets to other companies and now we have to fight another 20 years in court to get the assets returned to frank so he can return it to us. Now think if he transfered ownership five or six times. than that means 60 to 70 years before the company gets the assets back. Now if you use the carrot than frank just may turn the assets over. And while i would love to see frank in jail i would prefer money in my bank account. What about you?
