They are not going to fight RS with a team of lawyers lol. That would require actual work and planning to have a plan. Lol.

They will ask for extension and hope SEC takes as much as 45 days as possible.

Maybe they have meeting with a lawyer present. Then they RS whenever they want and say they put up a valiant effort.

ES and the gang could care less if RS.
Actually better for them.. they will issue more shares, sell the ATM, still get paid. All hunky dorie...
