I believe it was to the effect that in the case joint development each party had an equal stake/right to use for free, whereas something already existing was exclusive to that company. It was speculated that may be why there was such a long delay also in its start due to squabbling over the terms. Sigma benefitted also legally by not being a full member under the original agreement, they actually revised the program terms after the fact because of sigmas situation in benefitting without the costs lol. (Yay grandfathering)
