You are naive to think pinks cannot be shorted. It depends on your broker. If your broker goes through the DTCC and uses a clearing house, then no, they will not be able to issue shorted shares. If you use a broker like Vanguard that doesnt use a clearing house regulated by the DTCC, and has their own third party agent, then yes, if they have the shares available to short, you can short. It's a pain to do so or find a broker willing or capable of shorting.
