Very Interesting Thought:

When a company is sued for patent infringement and they lose the case...

...sometimes they are forced to "disgorge their profits" and turn them over to the winner.

This type of extreme legal result is factual but rare. But it may not happen here so it is purely hypothetical in the current case.

But hypothetically, if it DOES happen (DECN wins against J&J) then I have a feeling that the payout may be far more than $700 million. If damages are proven then any award could be trebled.

Best result could perhaps be a lot closer to $10 BILLION.

So, in the final analysis, this is all about weighting RISK vs REWARD.
